O COLÉGIO DE PRESIDENTES E CORREGEDORES DOS TRIBUNAIS REGIONAIS DO TRABALHO DO BRASIL – COLEPRECOR, entidade civil de âmbito nacional, vem a público externar sua irresignação diante da votação do Projeto de Lei nº 4850/2016 finalizada em 30 de novembro de 2016 na Câmara dos Deputados.
A Câmara aprovou uma lei desfigurada, um arremedo com aparência de legalidade, criando a possibilidade de que os membros do Magistratura e do Ministério Público possam ser acusados de crime de abuso de autoridade pelas mais variadas e genéricas condutas. Desse modo, por exemplo, bastará que um Juiz tenha uma simples sentença reformada em grau de recurso para ser, potencialmente, alvo de uma ação criminal.
A ameaça direta a todos os Juízes e Membros do Ministério Público põe em risco as garantias constitucionais de autonomia e independência de seus membros, abalando-se frontalmente o princípio histórico da separação de poderes. Sem um Judiciário e Ministério Público independentes não há democracia.
Mais do que isso, a ameaça a tais instituições, a quem compete importantes funções constitucionais, representa um ataque a toda a sociedade.
Esperamos que o Parlamento possa repensar os elementos indispensáveis entre os poderes da República, prevalecendo os mais altos interesses da Nação e da ordem democrática.
O COLEPRECOR estará vigilante a qualquer movimento de tentar-se criminalizar a atuação da magistratura e tomará as medidas jurídicas necessárias para impedir tal ruptura da ordem constitucional.
